FALCON STUDIOS' "CROSS COUNTRY" SWEEPSTAKES OFFICIAL RULES
DEADLINE FOR ENTRIES IS WEDNESDAY, NOVEMBER 30, 2005.
Participation constitutes participant's full and unconditional agreement to and acceptance of these Official Rules.
NO PURCHASE NECESSARY TO ENTER OR WIN. MUST BE 18 YEARS OF AGE OR OLDER TO ENTER. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING.
Eligibility:
Sweepstakes is open only to natural persons who are legal residents of the 50 United States for the duration of the Sweepstakes. Sweepstakes may only be entered from and in eligible jurisdictions. This Sweepstakes is of an adult nature. Eligible U.S. residents are required to have reached the age of majority in their state of residence at the time of entry in order to participate. Employees, officers, directors, and agents of ConWest Resources/Falcon Studios, affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, their immediate family members and persons living in their same household, are not eligible to participate in the Sweepstakes. All applicable federal, state and local laws and regulations apply.
Privacy:
ConWest Resources/Falcon Studios ("Falcon Studios") collects personal data from the entries submitted for this Sweepstakes. Falcon Studios does not rent, sell or lend its mailing lists. If you do not wish to receive promotional offers from Falcon Studios, please send your request for exclusion from our future promotional offerings to Falcon Studios, Customer Service, P.O. Box 880906, San Francisco, CA 94188-0906, or by e-mail to customerservice@falconstudios.com.
Odds:
Odds of winning the Prize depend on the number of eligible entries received.
Selection of winner:
Winner will be determined by random drawing from all entries received. Date of the drawing will be Friday, December 30, 2005. Winner will be announced on Monday, January 2, 2006. Drawing will be held at the offices of Falcon Studios, P.O. Box 880906, San Francisco, CA 94188-0906. Winner will be notified by e-mail and Prize will be sent to the address submitted. Winning name will also be posted at www.falconstudios.com/win on Monday, January 2, 2006.
General Terms and Conditions:
By entering, each participant agrees to be bound by these Official Rules and the decisions of Falcon Studios, which shall be final. Falcon Studios reserves the right to disqualify any person or e-mail address that Falcon Studios determines to be in violation of any term contained in these Official Rules. Falcon Studios, and the employees, officers, directors, shareholders, agents and representatives of Falcon Studios, their parent companies, affiliates, subsidiaries, advertising, promotion and fulfillment agencies and legal advisors are not responsible for and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, stolen, incomplete, illegible, unintelligible or postage-due entries, notices, releases, forms, affidavits or other correspondence; (ii) telephone, electronic, hardware or software program, network, Internet or computer malfunctions, failures, interruptions or difficulties of any kind; (iii) failed, incomplete, garbled or delayed computer transmissions; (iv) any condition caused by events beyond the control of the Sponsor that may cause the Sweepstakes to be disrupted or corrupted; (v) any injuries, losses or damages of any kind arising in connections with or as a result of the prize or acceptance, possession or use of the prize or from participation in the Sweepstakes or arising from the participant's access to and us of the Internet including without limitation, personal injury, death and property damage and claims based on publicity rights, defamation or invasion of privacy to the extent permitted by law; or (vi) any errors in any materials associated with the Sweepstakes. Falcon Studios reserves the right, in its sole discretion, to suspend or cancel Sweepstakes at any time if a computer virus, bug, worms, tampering, unauthorized intervention, fraud or other technical problem corrupts the administration, security or proper play of the Sweepstakes. In the event of such cancellation, Falcon Studios reserves the right to award prize in a random drawing from all entries received prior to the time of cancellation.
Disputes:
Sweepstakes is governed by the laws of the United States and the state of California. As a condition of participating in the Sweepstakes, participant agrees that any disputes that cannot be resolved between parties, and causes of action arising out of our connection with the Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively, by arbitration, located in San Francisco, California. Arbitration shall proceed under the rules of the American Arbitration Association.
Winner List:
The winner will be posted on www.falconstudios.com/win at the conclusion of Sweepstakes. To obtain verification of the winner's name or a copy of the Official Rules send your request along with a stamped, self-addressed envelope to: Falcon Studios, Cross Country Sweepstakes, P.O. Box 880906, San Francisco, CA 94188-0906.
HOW TO ENTER:
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING.
To enter online go to www.falconstudios.com/win and enter the required information on the registration form displayed. To enter by mail, print you name, address, date of birth and e-mail address (if any) on a 3"x5" piece of paper and send to: Falcon Studios, Cross Country Sweepstakes, P.O. Box 880906, San Francisco, CA 94188-0906. Once you have submitted the necessary information, your name will be automatically entered into a random drawing for the Prize with all eligible entries received. All entries must be submitted on-line or by postal mail during the Sweepstakes period in accordance with these rules and all applicable directions for online entry as listed on the above noted web site, or the entry will be void. Those who do not fill in all the required fields will be disqualified. Online entries generated by a script, macro or other automated means will be disqualified. Falcon Studios is not responsible for lost, late, incomplete, illegible, incomprehensible or misdirected entries, bugs, failures in servers, hardware or software transmission failure or loss or delayed or corrupted data transmissions or any injury or damage to an entrant's or any other person's computer related to, or resulting from, downloading any portion of this Sweepstakes. All entries will become the property of Falcon Studios and none will be returned. Only one entry per person/household and only one entry per email address. This Sweepstakes is void where prohibited or restricted by law. Winner will be notified via e-mail and by postal mail that he or she, subject to verification, is the Prize winner. If the winner cannot be reached after a reasonable effort has been made during fourteen (14) business days from Falcon Studios' first attempt, or if an entrant is found to be ineligible, an alternate winner may be selected. If any Prize or Prize notification is returned as undeliverable, the winner may be disqualified, and an alternate winner may be selected. Prize is non-transferable. No prize substitutions.
WINNER/PRIZE:
One Prize will be awarded and will consist of:
a) Round Trip Airfare for two from any city within the United States to Auckland, New Zealand (approx. retail value: $2,000).
b) Seven nights lodging at Orongo Bay Homestead (http://www.thehomestead.co.nz) -- approx. retail value: $1,600.
c) $1,000 car rental/food allowance.
Winner will be responsible for all applicable taxes and gratuities.
The approximate retail value of Prize may vary, but in no event shall such Prize be in excess of five thousand dollars (US$5,000). No transfer, cash equivalent or Prize substitution allowed, except at Falcon Studios' sole discretion. Falcon Studios may require winner to sign an affidavit of eligibility and liability. Decisions made by Falcon Studios are final in all matters, including interpretation of these Official Rules and awarding of the Prize. Only one Prize will be awarded. All expenses not specified herein, including, without limitation, all federal, state and local taxes, will be the winner's sole responsibility.
CAUTION: ANY ATTEMPT TO DAMAGE ANY ONLINE SERVICE OR WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES VIOLATES CRIMINAL AND/OR CIVIL LAWS. IF SUCH AN ATTEMPT IS MADE, SPONSOR MAY DISQUALIFY ANY SWEEPSTAKES ENTRANT MAKING SUCH ATTEMPT AND SPONSOR MAY SEEK DAMAGES TO THE FULL EXTENT PERMITTED BY LAW.
